Isi artikelCurrent literature suggests that the adversarial legal system may undergo some changes or may even be transformed by a recent influx of women lawyers into the profession. Such research indicates that women may approach ethical problems differently than men. This paper examines the responses of family law lawyers in Vancouver, British Columbia and the surrounding Lower Mainland to a hypothetical case which requires an assessment of professional responsibilities in light of potential conflicts in personal moral values. In some ways morality of rights describes the ethics of a game of chess- each piece has a place, and each moves according to the rules. The chess pieces are hierarchically rated, and each has its own distinct role. The pieces remain separate and cannot occupy the same space. Rules and rights designate interaction and protect the identity of each piece. As long as conduct is fair and rules are followed, elimination of pieces is simply part of the game, a game which produces winners and losers. By comparison, morality of care governs a mountain-climbing expedition whose members are connected by a web or rope. They are interdependent and committed to the responsibility of safeguarding each other. Each now situation must be understood in its own terms and evaluated to determine how the community of climbers will be protected. Whether on a belay or in moving supplies from one camp to another, each person gains value by relationship to the group. Achievement occurs through community success.
