There are many ways for business people to lead the competition and seize the market. However, some actions are permitted by competition law and some of them are not permitted because they may cause lack of competition, inefficient of market and distortion of resources allocation. As the consequence of those, there is a changing consumer's welfare to producer's welfare which in turn causes consumer loss in price, quality and product range. One method of competition is known as predatory pricing. In many cases of predatory pricing taken place in america. judges have discenting opinion in deciding whether predatory pricing is unlawfull or not. Some belief that predatory pricing is broken the competition law only if selling price is lower than production cost and if business actor has capability to recover losses when he does a predatory pricing. Moreover, there should be proven that selling price lower than production cost may lead the business actor to drive out of market his competitor or pushes his competitor to make selling price adjustment caused uncompetiitve product.
