In an attempt to compare the costs of the U.S. system of regulating imports according to a series of laws with the benefits that the system provides, the author suggests that, on the basis of observable evidence, the legalistic system is probably more desirable than the most likely alternative, which would be to provide more discretionary power over trade matters to government officials. A prominent trade lawyer and professor of law at the University of Michigan, John H. Jackson was formerly general counsel for the Office of the President's Special Representative for Trade and Acting Deputy Special Representative for Trade. He has written extensively on international trade law and policy and on international economic law, and has served as a consultant on these subjects to the General Agreement on Tariffs and Trade, the U.S. Department of the Treasury, and the United Nations. An expanded and revised version of this article has been published as "Perspectives on the Jurisprudence of International Trade: Costs and Benefits of Legal Procedures in the United States," 82 Michigan Law Review, April-May 1984, pages 2601-2618.
