The objectives of this research is to examine the nature of the current mortgaging system of the rice fields by focusing on its causes and effects, its procedures and impacts. The study conducts four approaches, first, from the positive laws, the basic needs, the relevance of the exchange, and the aspects of the rice cultivation points of view, results indicated that economic and social status motivate the practice of current mortgaging system. Economic motive is the effort to fullfil the family economic needs. Whereas, the social motive is the effort to mantain social status as the land owner. At Margamulya, the agreement in the system of mortgage is determined by written agreement between the borrower (mortgager) and the lender (mortgagee) which consist of the price of the mortgage, the duration of contract, and the rights to cultivate. Practices of mortgaging sistem result in some impacts on the social mobility, decreased income, lack of the ability to reach the morgage contract, changing or polarization of land owner and arousing conflicts.
