This paper traces the events leading to the introduction of NEP and evaluates the legal nature of the NEP. Although not law, the NEP has been generally adhered to. It will be seen that this adherence was due not to any moral obligations to comply or that it reflected popular consciousness, but because of the prevailing legal, political and institutional structure which allows the state to impose non-legal sanctions.
