Abstract
Malaysia’s National Economic Policy (NEP), introduced in the aftermath of the 1969 racial riot, has two primary objectives – to eradicate poverty and restructure society. This paper traces the events leading to the introduction of NEP and evaluates the legal nature of the NEP. Although not law, the NEP has been generally adhered to. It will be seen that this adherence was due not to any moral obligations to comply or that it reflected popular consciousness, but because of the prevailing legal, political and institutional structure which allows the state to impose non-legal sanctions. Thus, although not law, the NEP carries with it the state’s coercive powers to induce compliance.
