The main characteristic of small business is economic activity to commited by “weak employers” or economic populist. According to Act Number 9 of 1995 regarding Small Business, the state has obligation to empowerment and safeguard small business in the economic activity in order to be a big and middle business. Legal protection for Small Business in the era of economic globalization is necesitated. With the existence of free market there is a requirement of small business protection since the business is susceptible to capital weaknesses, but the business has become a major means of livelihood for millions populist. The application of this awareness, however, requires well-suited conditions in its economic development to become a welfare state of Indonesia.
