Abstract
“Human dignity” is one of those words that a mere utterance evokes instinctive sense of respect. It is also one of those versatile notions that can be used to justify ending a life deemed too agonizing to carry on (for terminal patients asking to die with dignity) or to oppose taking human lives as projectiles in the wilderness of bio-technology (in banning stem-cell researches using human embryos) – as if human beings could find no better way to relate to each other without invoking the very concept that set the tone for global harmony since the mid twentieth century. Now a lingua franca across borders, the concept of human dignity found its way to international law through the “Philadelphia Declaration” of the International Labour Organization made in 1944;1 and soon became a defining language for the Charter of the United Nations (the Charter), when members of the fledging United Nations met in June 1945 yearning for a lasting peace once and for all. This vision affirmed the international community’s faith in “fundamental human rights, in the dignity and
worth of the human person, in the equal rights of men and women and of nations large and small”.2 As the dust of peace settled three years into the post-war era, “human dignity” became essential for the recipe of international human rights, with Article 1 of the Universal Declaration of Human Rights (UDHR), which proudly proclaims: “All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.”3 It received no less attention in the following sequels which later comprised a trilogy of the so-called “International Bills of Rights”.
