Abstract
The special children are normally born with disabilities whether mental and/or physical disabilities. There are cases where a person becomes disabled due to accident or sickness after the age of majority. Generally, in custody disputes or child maintenance, there have been no extra provisions for a disabled child even though disabilities children are given recognition by the United Nations. This paper aims to discover in the era of globalization, whether the law in Malaysia is just and equitable to provide relief and justice to these special children. It will look at and discuss the relevant laws that deal with rights of special children in custody disputes and maintenance. It will also discuss the position of special children in custody disputes and maintenance in Islamic Law.
