Isi artikelThe core debate throughout the history of criminology has been between theories of punishment. If punishment is always hurting, why punish? This is obviously an ethical question which searches for moral justification of punishment. Different answers to this question have been defended by different adherents of theories. This article critically discusses retributivism's reply as defended by its most important representatives, Kant and Hegel. Since men have autonomy and freedom - so runs the argument - they have to be responsible for their own action. Every wrongdoer deserves punishment; transgression demands retribution.
