The world sometimes ties itself into knots from which it appears impossible to escape without leaving at least some dead behind. In some of these situationist it might be considered permissible to kill one nonthreating innocent person in order to save larger number. Yet although it is sometimes permissible to kill a person to save others, it is not always so. Not all persons are fair targets. In this article I try to sort out who is a fair target and who is not by invoking the idea of the hypothetical contract. People make contracts because they have reasons for doing so. Good reasons for accepting a contract are considerations of fairness and prospects for a good outcome in terms of consequences. Fairness will be explained by individuals' interest in controlling their exposure to risk. I restrict my discussion of consequences to a consideration of the probability of avoiding sudden death as reason for accepting or rejecting a contract. We might, of take other considerations into account. The problem in that case would be to trade those considerations againts each other.
