The awareness of the significance of witness and victim protection in criminal court process has recently been on the rise. The weakness of witness and victim protection system has resulted in the witness and victim's reluctance in reporting the case and testifiying in revealing of crime. As a matter of fact, the existance of criminal regulations prior to the enactment of the Act number 13 of 2007 on Victim and Witness Protection (hereinafter called UUPSK) has already covered provisions related to witness and victim, either explicitly or implicitly. However those scattered regulations were not sufficient since they were not formulated comprehensively and in detail. By the promulgation of the Act number 13 of 2007 on Victim and Witness Protection (UUPSK) there has been room for improving the quality of victim and witness protection. It is expected to contribute to the effectiveness of criminal court process. The problem related to the weakness of UUPSK and time existing limitation of structure and infrastructure should be responded progressively by those involved in the implementation of victimv and witness protection. Therefore, the prospect of victim and witness protection in te future does not depend merely on the existence of UUPSK, but it is also influenced by the way of how Indonesian people deal with socio-cultural, political and economic problems which have been the challenge for implementing victim and witness protection system.
