Isi artikelA ship or vessel in law of goods has a strategic status, therefore the arrangement of ocean vessel and the guarantee institution should be regulated as specific. The prevailing provisions in the shipping atters such as the acts no. 21, 1992 about the shipping and government regulation no. 51, 2002, about the shipping matter related to the rights of goods and guarantee institutions of ocean vessel primarily the mortgage are still referred to civil code (burgerlijk wetboek), commercial code (wetboek van koophandel) and regulation of ship registration (regeling van de teboekstelling van schepen 1933 no. 48). The ocean vessel according to section 510 burgerlijk wetboek (civil code) is moving object, if the vessel has gross tonnage less than 20 cubicmeter or more but unregistered then its guarantee institution is the fiducia subjected to the acts no. 42, 1999, whilst the vessel is the registered moving object treated as the unmoving object then its guarantee institution is the mortgage (hipotek) subejcted to the provision of the act no. 21, 1992, government regulation for shipping matter, wetboek van koophandel (WvK) and burgerlijk wetboek (BW). These regulations have been perceived as unable to accomodate the changing of business needs, especially with the presence of division demand of registered object and non registered obejct as stated in the acts no. 42 of year 1999.
