Necessity will make available land for development, offering the opportunity for the transfer of land for several projects. whether for state of public requirements, or for business necessity for that matter. in either a sn:ail or a large scale. Because the state owned land is no longer satisfactory in supply. it is desirable that theNe various necessities for land, which in a way, are objects for the need for the rig/u to prossess land, whether it as individuals or by a legal boav. by by the legal community (adal) be there. Regulating or controlling this aspect Lc not that easy. This is because there of ten occurs a discrepancv between das solien and das sein This writing will attempt to analyze the implementation of the kepres No. 55 of / 993 whose operationalization was supported by the ministerial regulation Agrarian/Head of BPN No. 1 of 1994, by revising what was meant by pzthlic importance, how its deliberation should be executed in tile process of fieeing land, how the loss should be shared. how the procession of the transferred land should he in the hands of the legal community (adat). From the results ot the analysis, it is concluded that the concept of public importance. the discussion and sharing the loss, all experience a shifi. with the validity of the kepres discussed above, it is apparent that ills only government which has the right to use tile land meant/hr public importance for oilier development activities.
